International Traffic in Arms Regulations (ITAR)

The Directorate of Defense Trade Controls (DDTC), Bureau of Political-Military Affairs, in accordance with 22 U.S.C. 2778-2780 of the Arms Export Control Act (AECA) and the International Traffic in Arms Regulations (ITAR) (22 CFR Parts 120-130), is charged with controlling the export and temporary import of defense articles and defense services covered by the United States Munitions List (USML).

Use the instructions on this page when you need to fabricate a project that is categorized as ITAR. The online ITAR Assignment is accessed by logging into Project Management and following the link to the required form.

ITAR Instruction

  1. Determine if your project is subject to ITAR, as laid out by the U.S. State Department, Directorate of Defense Trade Controls (DDTC).
    For additional assistance send an inquiry through the Web-based MOSIS customer support system and select "ITAR/Export Issues" from the pulldown menu of categories.
  2. Send a request for custom quote.
  3. Design your project in an ITAR compliant process.
  4. Notify MOSIS of your ITAR coordinator and technical personnel contact information by using the MOSIS Online Support System. Your ITAR coordinator is usually the person in your organization responsible for security clearances. MOSIS must receive and record this information before you can proceed any further.
  5. Specify ITAR in your New Project request. MOSIS will reject your request if we have not received and logged your organization's ITAR contact details as per step 4.
  6. Submit the ITAR Questionnaire which is available by logging into Project Management. A design number (assigned in step 5) is required to do this.
  7. For submissions that require a purchase order, see the Purchase Orders section below.
  8. Send your layout in an ITAR-compliant fashion. You can upload your layout via secure web form (HTTPS) (recommended) or Contact MOSIS via the MOSIS Online Support System for other possible methods.

HTS Code

As required by the foundries, all ITAR customers must assign their Harmonized Tariff Schedule (HTS) Code.

The Harmonized Tariff Schedule (HTS) comprises a hierarchical structure for describing all goods in trade for duty, quota, and statistical purposes. This structure is based upon the international Harmonized Commodity Description and Coding System (HS), administered by the World Customs Organization in Brussels; the 4- and 6-digit HS product categories are subdivided into 8-digit unique U.S. rate lines and 10-digit non-legal statistical reporting categories. Classification of goods in this system must be done in accordance with the General and Additional U.S. Rules of Interpretation, starting at the 4-digit heading level to find the most specific provision and then moving to the subordinate categories.

Purchase Orders

For all submissions subject to International Traffic in Arms Regulations (ITAR) that require a purchase order, specific information must be provided in the body of the purchase order. Although some of this information may have been provided to MOSIS under separate cover, it must also appear in the purchase order.

  1. The address in the Ship-To field of the purchase order must be an address approved by your organization's ITAR coordinator. There cannot be a different shipping address in the body of the purchase order. If you are unable to meet this requirement please send a message through the MOSIS Support System.
